Terms & Conditions
Italy Made Clear Last updated: [DATE] Effective from: [DATE]
1. Who we are
Italy Made Clear ("the Service", "we", "us", "our") is operated by:
[LEGAL ENTITY / P.IVA / address — to confirm before go-live] Email: hello@christaudien.me (preferred: support@italymadeclear.com — set up before launch)
Italy Made Clear is an information and tools subscription. We are not a law firm, accountancy practice, or regulated financial services provider. Nothing in the Service constitutes legal, tax, or financial advice.
2. Acceptance of these terms
By creating an account or subscribing to Italy Made Clear, you confirm that you:
- are at least 18 years old
- have read and agree to these Terms & Conditions
- have read our Privacy Policy and Cookie Policy
If you do not agree, do not use the Service.
These terms form a binding contract between you and the operator named in Section 1.
3. What Italy Made Clear provides
3.1 The Service
Italy Made Clear is a paid subscription that translates Italian bureaucratic systems — property tax, residency, permits, codice fiscale, driving licences, tax obligations, and related topics — into clear English for US and UK nationals living in, buying property in, or moving to Italy.
The Service includes, depending on the plan active at the time:
- Interactive tools and calculators (e.g., IMU estimation, rendita catastale explainers)
- Personalised guidance based on the preferences you provide (home country, destination region, journey stage)
- A regularly updated regulatory feed summarising changes at Agenzia delle Entrate, Ministero dell'Interno, and equivalent bodies
- Access to specialist AI-assisted tools for common Italian bureaucratic processes
3.2 What the Service is not
Italy Made Clear provides information and tools — not professional advice. Specifically:
- We are not a solicitor, avvocato, or legal representative. Nothing we publish is legal advice.
- We are not a commercialista or dottore commercialista. Nothing we publish is accounting or tax advice.
- We are not a financial adviser. Nothing we publish is financial advice.
- Calculations and estimates are illustrative only. They are derived from publicly available rate data and your inputs. They are not a substitute for official calculations by your Comune, Agenzia delle Entrate, or a qualified professional.
We say this not to disclaim everything, but because it is true: your specific situation may have variables our tools cannot anticipate. Verify figures with your Comune and confirm important decisions with a qualified Italian professional.
4. Subscription and billing
4.1 Plans
Italy Made Clear is available on two subscription plans:
- Annual plan: [PRICE] per year, billed once at purchase
- Monthly plan: [PRICE] per month, billed monthly
Current prices are shown at italymadeclear.com/pricing. We reserve the right to change prices. Any price change affecting your active subscription will be communicated by email at least 30 days in advance. Continuing to use the Service after the change takes effect constitutes acceptance of the new price.
4.2 Auto-renewal
Subscriptions renew automatically unless cancelled before the renewal date:
- Annual subscriptions renew annually on the anniversary of your purchase date.
- Monthly subscriptions renew monthly on the same date each month.
You will receive a reminder email at least 7 days before each annual renewal. You can cancel at any time — see Section 5.
4.3 Payment processing
Payments are processed by Stripe, Inc. We do not store your card details. By subscribing, you authorise Stripe to charge the payment method you provide on the schedule described above. Stripe's terms apply to payment processing: stripe.com/legal.
4.4 Failed payments
If a payment fails, we will attempt to notify you by email. Access to the Service may be suspended if payment cannot be collected after reasonable retry attempts. We will restore access promptly once payment is resolved.
4.5 Taxes
Prices shown include Italian VAT where applicable. If you are based outside the EU, different tax treatment may apply. You are responsible for any additional taxes imposed by your own jurisdiction.
5. Cancellation
5.1 How to cancel
You can cancel your subscription at any time from your account settings at italymadeclear.com/account, or by emailing hello@christaudien.me. Cancellation takes effect at the end of the current billing period.
5.2 What happens after cancellation
After cancellation:
- You retain access to the Service until the end of the period you have paid for.
- Your account and saved preferences are retained for 90 days, after which they may be deleted. You can request immediate deletion at any time under our Privacy Policy.
- No partial refund is issued for unused time within a billing period, except as described in our Refund Policy.
5.3 Refunds
See our separate Refund Policy for details of our 30-day money-back guarantee and related conditions.
6. EU right of withdrawal (digital content)
Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal from the date of subscription. However, by requesting immediate access to the digital content at the time of purchase, you acknowledge that supply begins immediately and — under Article 16(m) of Directive 2011/83/EU — the right of withdrawal is waived once supply has begun.
This does not limit your rights under our 30-day money-back guarantee, which is a commercial guarantee we offer separately and which is more generous than the statutory minimum. The guarantee is described in our Refund Policy.
If you do not wish to waive the 14-day withdrawal right, do not activate immediate access and contact us at hello@christaudien.me before your subscription begins.
7. Acceptable use
You agree not to:
- Share your account credentials or allow others to access your subscription
- Reproduce, copy, redistribute, or resell the Service's content without written permission
- Use the Service to provide commercial advice, consulting, or research services to third parties
- Attempt to reverse-engineer, scrape, or extract data from the Service in bulk
- Introduce malware, interfere with Service operation, or attempt to gain unauthorised access
- Use the Service in any way that violates applicable law
We reserve the right to suspend or terminate accounts that breach these rules, without refund.
8. Intellectual property
8.1 Our content
All content within Italy Made Clear — including written explainers, tool designs, calculations, regulatory commentary, the feed, and the product itself — is owned by or licensed to the operator named in Section 1. You may not reproduce, distribute, or create derivative works from it without written permission, except for personal, non-commercial use.
8.2 Your content
Where the Service allows you to submit preferences, notes, or other inputs, you retain ownership of what you submit. You grant us a limited licence to use that input to provide the Service to you.
8.3 Open data
Some data underlying the Service (e.g., Comune IMU rates, Agenzia delle Entrate tax brackets) is derived from public Italian government sources. Where that data is used, we present it accurately but we cannot guarantee that public source data is current or error-free.
9. Disclaimers and accuracy
9.1 Accuracy
We make reasonable efforts to keep the information in the Service current. Italian regulations change frequently. Despite our monitoring processes, there may be a lag between a regulatory change and its reflection in the Service.
No information in the Service should be treated as definitive. Always verify:
- IMU and TARI amounts with your Comune before payment
- Tax obligations with a qualified commercialista
- Residency and permit requirements with the relevant Questura or Prefettura
9.2 Estimates
Where the Service provides estimated figures (property tax, applicable rates, deadlines), those estimates are based on your inputs and publicly available rate data. They are indicative only. The actual amounts may differ.
9.3 "As is" service
The Service is provided "as is" without warranties of any kind, express or implied, except as required by mandatory Italian and EU consumer law. We do not warrant that the Service will be error-free, uninterrupted, or suitable for any specific purpose beyond general information and tools.
10. Limitation of liability
To the maximum extent permitted by Italian law:
- We are not liable for any financial loss, tax penalties, missed deadlines, or legal consequences arising from your reliance on information provided by the Service.
- Our total liability to you for any claim arising from the Service is limited to the amount you paid in subscription fees in the 12 months preceding the claim.
- We are not liable for indirect, consequential, special, or punitive damages.
Nothing in these terms excludes liability for fraud, gross negligence, death, or personal injury caused by our negligence — or any other liability that cannot lawfully be excluded under Italian or EU consumer law.
11. Changes to the Service
We may update, modify, or discontinue features of the Service at any time. We will give reasonable notice of material changes. If we discontinue the Service entirely, we will provide subscribers with at least 30 days' notice and a pro-rated refund for any remaining paid period.
12. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms. If you do not accept the changes, you may cancel before they take effect.
13. Governing law and disputes
These terms are governed by the law of Italy. The parties agree to attempt to resolve any dispute informally in the first instance. If a dispute cannot be resolved informally, the courts of [CITY — to confirm, typically operator's registered address], Italy shall have jurisdiction, subject to any mandatory consumer protection rules that apply in your country of residence.
If you are a consumer based in the EU, you may also use the EU Online Dispute Resolution platform: ec.europa.eu/odr.
14. Severability
If any provision of these terms is found unenforceable, the remaining provisions remain in full force.
